The new environmental regulations created by the Biodiversity and Protected Areas Service (SBAP) have raised concerns in the productive sectors due to the scope of their implementation and the effects they could have on various industries. This new institutional framework is moving forward with its initial regulatory definitions, including the identification of 99 “priority sites” covering nearly 3.9 million hectares, including areas where mining operations and other economic activities take place.
Our director, Bernardita Calvo Urrutia, explained that the main concern arises because the “priority site” criterion is not yet being applied with the technical and legal support required by law, which creates a scenario of regulatory uncertainty for the various sectors involved.

We share the opinion piece by our partner Paulo Larrain, Head of our M&A practice, regarding the award in the Australis – Joyvio case.
‘Unfortunately, the ruling has raised more questions than answers, and which will have a negative effect on future M&A processes,’ he says.
