Today, 13 December 2024, the new Personal Data Protection Law (Law 21.719) was published in the Official Gazette, governing the processing of data and establishing an agency specialised in the protection of personal data. This regulation updates and replaces Law No. 19.628 on the Protection of Privacy, aligning Chilean legislation with international standards such as the General Data Protection Regulation (GDPR) of the European Union.

President Boric submitted to Congress a constitutional amendment bill modifying the governance of the judiciary, thereby creating the Council for Judicial Appointments (“Consejo de Nombramientos Judiciales”). The aim is to reduce the administrative workload of judges so that they can better focus on their jurisdictional functions, and to eliminate lawyers as appointed members, to avoid potential for conflict of interest due to the lack of regulation or adequate mechanisms for their proper management.

On August 26, 2024, the Chilean Congress passed the Personal Data Protection Bill, which is now under review by the Constitutional Court before being enacted by the President of the Republic and published in the Official Gazette. The bill modernizes the current regulation, replacing Law Nr. 19,628 on the Protection of Private Life, and aligns Chilean legislation on personal data processing with international standards, such as the General Data Protection Regulation (GDPR) of the European Union.

It is with great satisfaction that we share a ruling of the full Chilean Supreme Court of Justice in the case (Case Nr. 75.995-2021), whose defense was handled by our Litigation and Arbitration team, Ricardo A. López Vyhmeister, Felipe Riedel and Fernanda Saavedra Renard.

In this ruling, among other matters, the Supreme Court Plenary adheres in a divided vote to the “notification thesis”, i.e., that the notification of the claim is a constitutive element of the interruption of the statute of limitations, since the purposes of such institution make it advisable that its interruption constitutes a concrete and known act, which is achieved with the notification.

Furthermore, in the fourth decidendi or reasoning -on the calculation of the period for the statute of limitations in civil matters-, the Plenary ruled concluding that it must be computed from the date on which the damage was caused and not from the date of the criminal judgment that punished the driver of the vehicle.

On December 30, 2023, Law 21,641 was published in the Chilean Official Gazette, amending Lawy 20720 on Insolvency and Bankruptcy. This amendment exempts certain contracts from the restriction to bring them to an early termination during the insolvency financial protection in judicial reorganization proceedings, and allows the operation of compensations with respect to obligations arising from such contracts once the liquidation resolution is issued in the liquidation proceedings.

Specifically, it amended Article 57 of Law No. 20. 720, excluding from the restriction to terminate early, demand early compliance or make effective the guarantees contracted invoking as a cause the initiation of a judicial reorganization proceeding, those contracts entered into by the debtor corresponding to sale and repurchase agreements, sale and repurchase agreements or other transactions in any title, right, act, contract, invoice, product or foreign currency, negotiable in domestic or foreign markets (“REPO transactions”), in which the debtor is an institutional investor.
